CITY OF TAYLORVILLE ORDINANCE NO. 3324 AN ORDINANCE ADDING TITLE 5, CHAPTER 4, SECTION 4-9 TO THE CITY CODE OF THE CITY OF TAYLORVILLE, CHRISTIAN COUNTY, ILLINOIS (REGULATING PEOPLE UNDER 21 YEARS OF AGE FROM POSSESSING AND CONSUMING ALCOHOLIC BEVERAGES)

CITY OF TAYLORVILLE ORDINANCE NO. 3324 AN ORDINANCE ADDING TITLE 5, CHAPTER 4, SECTION 4-9 TO THE CITY CODE OF THE CITY OF TAYLORVILLE, CHRISTIAN COUNTY, ILLINOIS (REGULATING PEOPLE UNDER 21 YEARS OF AGE FROM POSSESSING AND CONSUMING ALCOHOLIC BEVERAGES) WHEREAS, the Mayor and City Council of the City of Taylorville believe it is in the best interest of the public health, safety, morals, and welfare of the residents of the City of Taylorville and those people who enter the territorial jurisdiction of the City of Taylorville to regulate people under the age of 21 from possessing and consuming alcoholic beverages. NOW THEREFORE, BE IT ORDAINED by the Mayor and the City Council of Taylorville, Illinois, as follows: SECTION 1: The following section shall be added as Title 5, Chapter 4, Section 4-9 to the City Code of the City of Taylorville: 5-4-4- PRESENCE ON PREMISES WHERE PEOPLE UNDER THE AGE OF 21 YEARS ARE POSSESSING OR CONSUMING ALCOHOLIC BEVERAGES (a) A person who knowingly enters or remains in any house, building, yard or other premises, other than premises licensed to sell alcoholic liquor, under circumstances where the person knows or reasonably should know that alcoholic liquor is being illegally possessed or consumed by persons under the age of 21 years shall be guilty of a petty offense and, upon conviction, shall be punished by a fine of not less than $200.00 nor more than $500.00. (b) It is unlawful for a parent, legal guardian, or other person, to knowingly permit a person under the age of 21 years old in his or her custody to violate the provisions of subsection (a) of this section. Any person convicted of a violation of this subsection shall be fined not less than $500.00. (c) Nothing in this Ordinance shall prohibit the possession and dispensing, or consumption by a person under 21 years of age of alcoholic liquor in the performance of a religious service or ceremony, or the consumption by a person under 21 years of age under the direct supervision and approval of the parents or parent or those persons standing in loco parents of such person under 21 years of age in the privacy of a home as allowed by the Illinois Liquor Control Act (235 ILCS 5/6-20).
SECTION 2: This ordinance shall be incorporated in the City Code of Taylorville, Illinois as Title 5, Chapter 4, Section 4-9. SECTION 3: The provisions of other City of Taylorville ordinances, to the extent that they duplicate, conflict with, or otherwise affect the validity hereof, shall be disregarded, and otherwise, all the provisions of all other City of Taylorville ordinances shall remain in full force and effect. SECTION 4: This ordinance shall become effective upon its passage, approval, adoption, and publication in pamphlet form as provided by law.

The pamphlet form of Ordinance No. 3324, including the Ordinance and cover sheet thereof was prepared, and a copy of such Ordinance was posted in the City Hall, commencing on February 6 , 2007, and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of the City Clerk.
